PATENTS ACT
The Patents Act 57 of 1978 regulates patent protection in South Africa. A Patent can be granted for any new invention which involves an inventive step and is capable of being used or applied in trade or industry or agriculture.
Patent protection is granted for a period of 20 years.
South Africa is party to the Patent Cooperation Treaty which allows a national or resident of a member country to file a single PCT application which application may be followed thereafter in other member countries at a later stage (18 months) whilst priority is claimed on the initial application.
